We act both in defence of professionals and, by way of subrogation, against them. Our work in this area draws heavily on our knowledge of the construction and engineering industries, as well as on our insurance expertise.
In the construction sector, we have recently concluded cases such as the collapse of a dam, and a faulty fire suppression system which allowed a small fire to develop into one that quickly destroyed a new set of buildings.
In the insurance sector, the insured will often seek explanations – and sometimes redress – from their broker whenever an insurer declines a claim on a point of coverage. After all, it is the broker’s job to arrange cover for all eventualities. Our view is that the claimant’s representatives have to do more than suggest that the cover might have been made more comprehensive with hindsight; they have to make a convincing case for professional negligence.
