Greenwoods calls for a review of the funding of long term care requirements

Greenwoods Solicitors, the leading insurance law practice, is proposing a comprehensive review of the provision and funding of long term care requirements of all victims of accidents.

The initiative, which has the backing of RBS Insurance and Norwich Union, will be launched at Greenwoods’ Major Bodily Injury Group Spring seminar ‘A time for change’ on 24th March 2009, at the Institute of Directors in London.

Commenting on the initiative, Malcolm Henke of Greenwoods, who will be hosting the event, said:

“It is apparent that insurers’ concerns about the exponential rise in the cost of personal injury claims can only be adequately addressed by a fundamental reform of the way in which damages are assessed. This seminar will outline proposals for such reforms and the steps already being taken to implement them.”

There has been a significant divergence in the way in which care has been provided to individuals who have been seriously injured in accidents, depending on whether or not they have a claim for compensation against another party and, as a result, two classes of patient have developed.

The first group is patients who have no recourse to a tortfeasor and who remain dependant on public funding through the NHS and /or local authorities. The second group is claimants who receive compensation to enable them to establish privately funded care regimes but who may also be supported by the public purse.

Greenwoods is calling for greater consistency between the way in which the care needs of the two classes of individuals are assessed and delivered.

Stephen Worthington QC, of 12 King’s Bench Walk will speak about why reform is needed and Edward Garnier QC, MP and Shadow Minister for Justice and a consultant to Greenwoods will give an insight into HM Opposition’s view on the subject, whilst Geoff Owen, also a consultant to Greenwoods, will present an outline of the Greenwoods proposals.
