Insurance Coverage Disputes

  • Non-disclosure and misrepresentation
  • Breach of policy terms and conditions
  • Contribution claims
  • Reinsurance collections and accounting
  • Subrogation issues

Disputes over coverage can threaten an insurer’s reputation, so it is prudent to instruct us as early as possible after the dispute arises to enable us to control the tempo of negotiations and to focus the response under the policy.

Through early involvement, we can coordinate the efforts of loss adjusters, industry experts and the insurer’s special investigations unit to ensure that all the requirements of good faith are observed while rigorous investigation is being made.

Where there is a suspicion of fraud, we adopt a disciplined forensic approach to determine, for instance, whether the insured has deliberately obscured the facts to obtain cover, or whether the broker has inadvertently overlooked an important detail.
