Our approach and philosophy for handling personal injury cases in the “utmost severity” category is firstly to ensure that our lawyers have a thorough technical understanding of the issues that are involved. That means an understanding of brain and spinal cord injury, its consequences in terms of family dynamics and impact within society, which inevitably affects the value of the claim. Close links with the Spinal Injury Association, internal training programmes and significant exposure to such cases ensures that the lawyers handling this work are amongst the most experienced with the UK. They keep up to date with the latest developments in surgery, rehabilitation and occupational therapy, and maintain close links with the UK’s leading experts in these and other relevant fields.
We are currently handling cases within this category with a total reserve of in excess of £500m. This expertise, combined with a commercial approach based upon insurer clients’ specific (and sometimes differing) requirements, continues to inform and develop our approach.
The basic philosophy is speed through rehabilitation and a consensual approach. Rehabilitation must be targeted and focussed on the areas of greatest potential for success with a view to reintegrating catastrophically injured claimants as fully as the limitations of their injuries permit. We adopt a consensual approach, insofar as possible, with those representing claimants to ensure that we maximise our ability to influence the recovery and rehabilitation phase with an eye on achieving the best outcome for our clients which invariably means the fullest recovery possible of the claimant.
Where appropriate, a supporting team of lawyers and administrative staff is available to handle the more routine aspects of this caseload. This allows our senior specialists to focus their attention on the most complex elements of each case.
Whilst many CAT PI claims can be settled without recourse to the courts, even where litigation occurs there is no reason why this should delay the process. Control is the key; we endeavour to work towards a consensual agreement but we make sure that we also build a solid basis for litigation if required, so that in the event that the case comes to court, there is a good prospect of achieving a favourable outcome.
