As with the rest of the firm, the work of our Commercial & Financial Risks Group is very much insurance and claims related. What distinguishes it is its high commercial content, with fee-earners acting as commercial as well as insurance litigators.
Why? Because insurance claims are often accompanied by parallel commercial disputes. Typically, this arises when an insured triggers a claim for insured damages by applying for unpaid fees or costs. In such cases, we have to tread carefully through competing contracts, applicable terms and exclusions and, possibly, unfair contract terms.
We also offer pre-emptive advice to property and construction companies and their advisers. Our technical knowledge of the sector equips us well to help them adjust their contracts, warranties and insurance arrangements to avoid misunderstandings and disputes further down the line.
